Tips to Avoid a Ringless Voicemail Suit
Ringless voicemail lawsuits often filed against telemarketers that attempt to stop legitimate telemarketing phone calls from being made are often only heard by the person who placed the telecast. When this happens, the recipient may have no idea who the telemarketer is, or even if the person was being called at all, and so a lawsuit is filed, as well as a lawsuit can be brought to the attention of the number’s owner. The best way to protect yourself in such a situation is to immediately notify the company you bought the message from or the person who placed it.
The way to prevent such a lawsuit is to never ever sign over a message for any reason. Even when the message you are giving has been altered to be something else or deleted from your voice mail, if you do not report the person who gave you the message to authorities in the first place, you are at least taking away one potential lawsuit, albeit minor.
If you wish to report a person, who has given you a defective or fraudulent message, it is advisable to try and resolve the problem with them through other means. Although it is unlikely that you will get the message back, at least they will have learned to avoid the company where the message originated.
It is also wise to try and avoid being sued in any case. If you are not certain of the validity of the messages that are being delivered, or whether they are indeed legal ones, you should not waste your time calling the number or returning voice mail.
You may also want to use an email or voice mail protection software program to make sure that any messages you place on the computer are not recorded on the computer or the voice mail. This will ensure that if you do receive a lawsuit, you do not have anything to lose and everything to gain because your attorney may be able to show that you had nothing to say to the person who did the recording, and that you did not hear any other conversation about the message.
In addition, if you are wondering how to make sure that the person you are calling knows that you do not want a voice mail or the recording of the message, try to avoid having them answer with a yes answer unless the person has asked for your permission to have the recording made. Even then, the person may be able to claim that they were unaware of this particular recording and therefore, they may not have a case against you.
It is extremely important for you to note that, in many cases, it is not always possible to protect yourself from a lawsuit. and you may still be forced to pay a lawsuit settlement to the person who sent the message or a lawsuit.
For instance, if the recording was done so that they were able to monitor who you talked to, or that the person did not even speak, you may find yourself being sued. Also, there are some situations where, although you may not wish to file a lawsuit but, you do want to warn others about the telemarketer and have them stop calling you, and you cannot find an alternative method to do this.
The best possible way to do this is to file a complaint with the Better Business Bureau, as this is the only way that they can investigate and determine if the person that you are suing has a history of frivolous lawsuits and what they have been found guilty of. Even if they have not, the complaint will probably be filed anyway, as it is the law to file such a complaint as long as you have provided them with all of the information that is necessary to back up your claims.
You may also want to consider filing a complaint with the Attorney General’s office, especially if you feel that you are being threatened by the person that you are suing, or if the call you are receiving is coming from someone that is harassing you regarding any legal issues. If they cannot prove that they were not threatening you, they may be able to have the case dismissed.
It is very important for you to remember that, although you may think that you have no grounds to sue them, the person you are suing may have a personal injury case. or even a lawsuit against you for some other reason.
